These terms are the agreement between you and Xxxxxxx Systems, an independent software studio run by a small group of enthusiasts, for your use of Chit, the receipt-splitting app, and this website. Please read them, especially the parts in bold: they explain what Chit does not do and where our responsibility ends.
Chit is a tool for recording and splitting receipts. It does not move money, check who owes what, or verify the people you deal with. You remain responsible for what you enter, what you send and to whom, and any money that changes hands.
Key points (a summary only; the full terms below are what apply):
- Chit only keeps records. We never hold or move money, and we are not part of any arrangement between you and other people.
- Recognition, splits, insights and AI answers can be wrong. Check them before you rely on them or ask anyone to pay.
- Whatever you send to other people, in Chit or as a share image, can be kept and passed on by them. We cannot recall it.
- Data that has not been synced exists only on your phone. Shared receipts can expire, and are then permanently deleted from our servers.
- Chit is provided “as is”. We exclude or limit our liability as far as the law allows, without taking away your statutory rights.
- Chit Pro is billed by Apple or Google and renews automatically until you cancel it in your store account.
- Scots law applies, and so do the mandatory consumer protections where you live.
1. About these terms
These Terms of Use (“Terms”) are a legally binding agreement between you and Xxxxxxx Systems (“we”, “us”, “our”), an independent software studio run by a small group of enthusiasts (https://xxxxxxx.systems/). They cover the Chit app, the online services behind it (accounts, sync, sharing, the AI assistant and Chit Pro) and the chitsplit.app website, together “Chit”.
Our Privacy Policy explains how we handle personal data. If you turn on the AI assistant, its AI terms also apply and take priority over these Terms on matters about the assistant. The App Store or Google Play terms govern downloading Chit and paying for Chit Pro.
You can use Chit on your phone without an account. Before you sign in or create one, the app asks you to agree to these Terms and the Privacy Policy. By downloading, opening or using the app, or using this website, you also accept these Terms as far as the law allows. If you do not agree, do not use Chit.
A “consumer” means an individual using Chit wholly or mainly for purposes outside their trade, business, craft or profession. If a translation of these Terms differs from the English version, the English version applies.
2. Who can use Chit
You must be at least 13 years old. If you are under 18, a parent or guardian must agree to these Terms for you and supervise your use, and is responsible for purchases made on your store account. You may not use Chit if the law prevents you, or if we have closed your account for breaking these Terms, unless we agree otherwise.
Chit is made for personal use, such as sharing the cost of shopping, meals and bills with friends, flatmates and family. If you use it for a business, you do so at your own risk, and the business-use rules in sections 24 and 25 apply.
3. What Chit is, and what it is not
Chit helps you photograph receipts, turn them into line items, divide costs between people and keep a record of who has paid whom. Chit is not:
- a bank, payment service, escrow service or debt collector. We never hold, move, receive or process money for anyone;
- a party to any arrangement between you and other people. Who owes what, and whether it has been paid, is between you and them;
- a way of verifying anyone’s identity, or any debt, receipt or payment;
- financial, tax, legal, accounting or other professional advice;
- an official record. Chit records, summaries and share images are not receipts, invoices, VAT invoices, proof of payment or proof of a debt, and HMRC, an employer, a court or anyone else may not accept them. Keep original receipts where you need them;
- a backup service (see section 11).
4. Your account
An account is optional. You can sign in with a one-time code sent to your email, with Sign in with Apple, or with Google. Give accurate information and keep your email address up to date. An account is for one person: do not share, sell or transfer it, or use anyone else’s.
Keeping your account safe is your responsibility. Anyone who can read your email, use your Apple or Google account, or use your unlocked phone may be able to get into your Chit account. Never share a sign-in code; we will never ask for one. We treat activity in your account as yours. If you think someone else has accessed it, act straight away yourself: secure your email account and your Apple or Google account (for example by changing their passwords), sign out of Chit on all devices from the app, or delete your Chit account. Contact us only if you cannot do this yourself.
Usernames help friends find you; they do not prove who anyone is. Yours must not impersonate anyone, mislead, infringe anyone’s rights or be offensive. We may change, reclaim or remove a username that breaks these Terms or that someone complains about with good reason, telling you first where we can.
Sign-in emails may be delayed, filtered as spam or not arrive, and Apple and Google sign-in depend on their services. We are not responsible if you cannot sign in because of problems with your email or those services.
5. Receipts, recognition and splits
Chit reads receipts on your phone using text recognition from Apple or Google, then uses its own rules to identify items, discounts, fees and totals, expand abbreviations and check the lines against the total. It can misread numbers, miss or merge lines, or misinterpret abbreviations, offers, service charges or tax, especially on crumpled, faded, long or unusual receipts. When a long receipt is photographed in overlapping parts, removing duplicated lines can occasionally drop a genuine repeated item or count one twice. Chit flags lines it is unsure about, but a missing flag or a matching total does not mean the receipt was read correctly.
You can split evenly, by item (including shares such as 2:1) or by set amounts. Discounts follow their items and fees are shared in proportion, which may not match how the shop applied them or what your group intended. Amounts are worked out in whole pennies, so a share can differ by a few pence from an exact division; leftover pennies are allocated by a fixed rule and often fall to the person who paid. Personal rules (such as “Sam doesn’t share alcohol”) and habits learnt from past receipts only pre-fill suggestions. Chit can record different currencies but is not a source of exchange rates.
You are responsible for checking every item, amount, share and total before you rely on it, send it or ask anyone to pay, including anything another participant has changed.
6. People and friends
People in Chit are your own contact list inside the app; Chit never reads your phone’s address book. A contact can be a placeholder, just a name and a colour, for a friend without an account.
When you add people, name them, put them on receipts or comment on their items, you are handling information about them. You must have a right to do so, keep it accurate and limited to what is needed, and respect anyone who asks to be left out. You are responsible for the information you enter about others. Take particular care with children.
Friends are added by username, and the other person must accept. Only send or accept requests for people you know. When you link a placeholder to someone’s account, that person can see the sent receipts they are on, with every line, the photos and everyone’s shares. Make sure you link and add the right person.
7. Sending receipts and share images
Sending in Chit
A receipt is private until you send it. Once sent, participants with linked accounts can see the whole receipt: every line, the photos, each person’s share, comments and later changes. Photos are uploaded to our servers only for receipts you send. Before sending, check who is on the receipt, and check the photos for anything you do not want to share, such as card digits, loyalty numbers, addresses, people or other papers in the picture.
Share images
For people without the app, Chit can create an image on your phone of their items and what they owe, which you send through your phone’s share sheet to any app, such as WhatsApp, WeChat or email. Once you send a share image, it is outside Chit and outside our control. We cannot see, change, recall or delete it, and we are not responsible for where it goes or who sees it, including if it is forwarded or sent to the wrong person or group.
You can store your own bank details or payment link to include on share images. They stay on your phone and are not synced, but anyone who receives the image, or to whom it is passed on, can see them. Include only details you are happy to share, and check they are correct.
Copies stay with recipients
Anyone you share with can screenshot, save or forward what they see. Deleting a receipt, letting it expire or deleting your account does not remove copies other people have made.
8. Working together on shared receipts
For each receipt, the owner chooses who can edit: only the owner; participants can change who shares what; or participants can edit everything. Give wider permissions only to people you trust. Changes made by participants are their responsibility, not ours.
Participants can confirm their share or comment on a line. If amounts change after someone confirms, their confirmation is cleared and they are asked again. A confirmation records what someone tapped at that time; what it means between you is for you to decide. The change history is a helpful record, not a guaranteed or complete one. Settled receipts are locked until the owner unlocks them, after which they can change again.
Editing a sent receipt needs an internet connection. If your change conflicts with a newer version, for example because someone else edited while you were offline, Chit may keep the newer version, discard your change and ask you to redo it. Check that a receipt shows what you expect.
The owner controls the receipt. If they delete it, delete their account or let it expire, participants lose access. If a record matters to you, keep your own copy.
9. Settling up: money stays between you
Settling up in Chit is only a record. There are no payments in the app. You pay each other however you choose, such as bank transfer, PayPal or cash, outside Chit and under that service’s terms, then mark the debt as paid; where the app offers it, the person receiving can confirm. We do not check these records. A record that someone paid does not prove a payment was made, and a record that someone owes does not prove a debt exists.
We are not responsible for any money you pay, receive, overpay, lose or fail to recover, or for payments made to the wrong person or account.
Disagreements are between you. If you disagree with someone about who owes what, whether a split is fair or whether something was paid, you need to resolve it with them. We do not mediate, investigate, decide or enforce disputes between users, and we will not change another user’s records for you. We share information about a dispute only as our Privacy Policy and the law allow. You are responsible for any tax or reporting obligations connected with money you pay or receive.
10. Scams, impersonation and other users
We do not vet users, and other users are responsible for their own content and behaviour. Watch out for names or usernames that imitate a friend, fake or altered images made to look like Chit share images, urgent requests to pay a different account, friend requests from strangers, and pressure to confirm a share. Before paying, check the request with the person through a channel you already trust, especially if the payment details are new or have changed. A share image is not proof that anyone owes money; anyone can make a lookalike. We will never ask for a sign-in code or password, or ask you to pay us other than through the App Store or Google Play.
We are not responsible for losses caused by fraud, scams, deception or other misconduct by other users or third parties, including people pretending to be another user or us. If you think you have been scammed, contact your bank or payment provider immediately, report it to the police, and tell us at support@chitsplit.app.
11. Where your data is kept, and how it can be lost
On your phone
Without an account, everything you put into Chit is stored only on your phone. We have no copy of anything that has not been synced. If your phone is lost, stolen, damaged, reset or replaced, or you delete the app or its data, that data is gone and we cannot recover it. Whether your phone’s own backups include Chit depends on your settings and on Apple or Google.
On our servers
With an account, your receipts, contacts and repayment records sync to servers run by our hosting provider in London. Your payment details for share images stay on your phone. Sync needs a connection and can be delayed or fail. We may set reasonable limits, for example on storage, photos or how often features are used, to keep Chit running within the limits of our infrastructure; the app tells you where a limit affects you.
Expiry of shared receipts
When you share a receipt, you may be able to choose how long its cloud copy is kept; the options are shown in the app, and some may need Chit Pro. When that period ends, we permanently delete the cloud copy of the receipt and its photos, for the owner and every participant, and cannot restore it. Copies already on devices, screenshots and share images may remain. The owner is responsible for the period chosen; participants who want a lasting record should keep their own. “No expiry” means we do not delete a receipt on a timer, not that we promise to keep it forever: it can still be deleted by its owner, through deletion of the owner’s account, or under sections 21 and 22.
Chit is not a backup
Data can be lost or damaged through bugs, sync conflicts, device faults, outages at our providers or other causes. Keep your own copies of anything important, including the original receipts.
12. Privacy and security
Our Privacy Policy explains what personal data we collect, why, which providers process it, how long we keep it, and your rights. For privacy questions, write to privacy@chitsplit.app. Nothing in these Terms limits your rights under data protection law.
We use reasonable technical and organisational measures to protect your data, but no app, network or server is completely secure, and we cannot guarantee that your data will never be accessed, disclosed, altered or lost without permission. Help protect it by keeping your phone and Chit up to date, using a screen lock, securing your email and installing Chit only from the App Store or Google Play. Do not use Chit on a jailbroken, rooted or otherwise modified device.
If you think you have found a security weakness, tell us privately at support@chitsplit.app. Do not exploit or test it further, access anyone else’s data, or make it public before we have had a reasonable chance to fix it.
13. Insights and shop names
Monthly spending, price trends, the basket index and duplicate-receipt warnings are for information only. They are based solely on the data in your Chit, so they are only as accurate as the recognition and what you entered. They are not financial advice, official statistics or a complete picture of prices, and duplicate warnings can miss real duplicates or flag ones that are not.
Chit may show shop names and logos so you can recognise where a receipt came from. They belong to their owners, and showing them does not mean any shop endorses, sponsors or is connected with Chit. If you own a trade mark and object to how it appears in Chit, contact us.
14. The AI assistant
The AI assistant is optional and needs your separate agreement to its AI terms. It answers questions about your own Chit data and can prepare proposed changes to splits, and it declines unrelated requests. Its answers are generated automatically and may be inaccurate, incomplete or misleading, even when they sound confident. Receipts shared with you contain content written by other people, which can affect its answers. It does not give financial, tax, legal or other professional advice.
Nothing changes until you tap “Apply”, and the assistant works only with your own permissions. When you apply a proposal, the change is yours, just as if you had made it by hand, so check it first.
Before anything reaches our AI provider, people’s names are replaced with codes. The rest of what the assistant needs, such as items, shops, amounts, dates and what you type, is sent to the provider to produce an answer, so do not type information it does not need, such as bank or health details. The Privacy Policy names the provider before the assistant becomes available. Conversations are deleted after 30 days.
The assistant has a monthly allowance: very small on the free tier, much larger but still capped with Chit Pro (see section 15). We may change the assistant or its allowances, switch provider, or pause or withdraw it, for valid reasons such as the provider’s costs or availability, legal requirements, security or abuse.
15. Chit Pro
Chit Pro is an optional paid subscription; most of Chit is free. It includes what the app and store listing describe when you buy, currently a much larger AI allowance and more sharing options. You buy it through the App Store or Google Play. The price is shown in the store before you confirm and may vary by country. Apple or Google handles payment, billing, renewals, cancellation and refunds under their own terms. We use RevenueCat to track subscription status and never receive your card details.
Automatic renewal
- Payment is charged to your App Store or Google Play account when you confirm the purchase.
- Your subscription renews automatically at the then-current price unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
- You can manage or cancel your subscription in your App Store or Google Play account settings.
- Deleting the app or your Chit account does not cancel your subscription.
- If we offer a free trial, it becomes a paid subscription when it ends unless you cancel at least 24 hours before the end of the trial. Any unused part of a free trial is forfeited when you buy a subscription.
- If you cancel, Chit Pro continues until the end of the period you have paid for.
Refunds and your legal rights
Refunds are handled by Apple or Google under their policies; we cannot issue them ourselves. If you are a consumer, you may also have legal rights, including in some cases a right to cancel within 14 days, and remedies if paid digital content or services are faulty or not as described. Nothing in these Terms affects those rights. Apart from them and the store’s policies, there are no refunds or credits for partly used periods.
Allowances, prices and changes
Allowances apply for each allowance period shown in the app and reset at the start of the next. Unused allowance does not carry over, has no cash value and cannot be transferred. The Chit Pro allowance applies only while your subscription is active and recognised by our systems, which can take a short time after a purchase or renewal. If you have paid but Chit Pro does not appear, restore your purchases in the app first, and contact us only if that does not work.
We may change the price of Chit Pro. A new price applies only from a renewal after you have been told as the store and the law require, never to a period you have already paid for. If you do not want to pay it, cancel before it takes effect.
We may change Chit Pro’s features or allowances for valid reasons, such as changes in our AI provider’s pricing or availability, legal requirements, security, abuse or technical limits, and will give reasonable notice of any change that significantly reduces what it offers. If such a change, or our ending Chit Pro or Chit, significantly reduces what you have already paid for, you may be entitled to a refund for the unused part of your period, and we will tell you how to obtain it through the store.
If you misuse Chit Pro or the AI assistant, for example by sharing access, automating requests, reselling or getting around allowances, we may limit or suspend those features, without a refund unless the law requires one. If a payment for Chit Pro is reversed, Chit Pro may end.
16. Your content
“Your content” is what you put into Chit: receipts, photos, items, names you give people, comments, repayment records, messages to the assistant and anything else. You keep ownership of it.
You give us a non-exclusive, royalty-free, worldwide licence to host, store, copy, process, transmit, adapt (for example, by resizing photos) and display your content, only as far as needed to run, secure and support Chit, to provide the features you use (such as showing sent receipts to participants or sending your questions to the AI provider), and to comply with the law. Our service providers may do the same on our behalf. The licence ends when your content is deleted from our systems, except for content you have already shared with others, backups (deleted on the schedule in our Privacy Policy), and anything the law requires us to keep.
You promise that you have the right to put your content into Chit and share it, and that it is lawful and does not infringe anyone’s rights. We do not review content before it is shared and are not responsible for it, but we may act on it under section 18. If you send us ideas or feedback, we may use them freely without paying you or owing you anything.
17. Acceptable use
You must not use Chit, or try to use it, to:
- break any law, or help anyone else to;
- commit or hide fraud, money laundering, tax evasion, sanctions evasion or other financial crime, including by recording false receipts, debts or payments;
- create or send forged, altered or misleading receipts, images or records, or use Chit records to deceive anyone, such as an employer, insurer, landlord, authority or court;
- harass, threaten, bully, stalk or pressure anyone, including through friend requests, names or comments;
- post content that is unlawful, defamatory, hateful, sexually explicit or violent, or that infringes anyone’s rights;
- impersonate any person or organisation, including us or a shop;
- collect or share personal information about others without a right to do so, or send spam or bulk friend requests;
- access another person’s account or data without permission;
- scrape or collect data from Chit by automated means, or use Chit or its data to train AI models;
- copy, modify, reverse engineer or decompile the app, except as far as the law allows despite this restriction;
- probe Chit for vulnerabilities, get around its security, access controls, rate limits or allowances, introduce malware, or interfere with or overload Chit or its infrastructure;
- access our servers other than through the official app, resell or commercially exploit Chit, or use it to build a competing product;
- create several accounts to get around limits, suspensions or bans;
- make the AI assistant reveal other people’s data, bypass its safeguards or produce harmful content.
18. Reporting and enforcement
To report a user, receipt, name or comment that breaks these Terms, email support@chitsplit.app with the username and what is wrong. If someone is in immediate danger, contact the emergency services first.
We do not monitor content in advance and have no obligation to. We review reports within a reasonable time and may take no action, warn a user, remove or restrict content, limit features, suspend or close an account, keep relevant information, or report matters to the police or other authorities where the law requires or allows. We act in proportion to the problem and, where lawful, safe and practical, tell the person affected what we did and why. If you disagree with a decision about your content or account, or with how we handled your report, email us and we will look at it again.
We are not responsible for other users’ content or behaviour, whether or not it has been reported to us. If we do not act on a breach, that does not mean we accept it.
19. Our app and your licence to use it
Chit, including its code, design, text, graphics, and the Chit and 一票 names and logos, belongs to us or our licensors. These Terms do not transfer any of it to you. We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, and to use the website, for personal purposes in line with these Terms and the rules of the store you got Chit from. We keep all rights we do not expressly give you. Open-source components are covered by their own licences, which these Terms do not limit.
Some updates may be needed to keep using Chit or its online features, and are covered by these Terms. You are responsible for having a compatible phone, operating system and internet connection, and for any data charges. We may stop supporting older phones or operating systems.
20. Third-party services
Chit relies on other companies: Apple and Google (app stores, operating systems, text recognition, sign-in and payments), our hosting, email, subscription and AI providers, and the apps you share to. The Privacy Policy lists those that process personal data. Their services are governed by their own terms, which you may need to accept.
We do not control them, and we are not responsible for their availability, outages, errors, changes, security or acts, or for loss they cause, unless we failed to take reasonable care in choosing or using them. If a provider changes or withdraws a service, parts of Chit may change or stop, and we may switch providers. Links to other websites are for convenience only.
21. Changes, availability and ending the service
We aim to keep Chit running, but we do not promise that it or any feature will be available at any particular time, without interruption or errors, or in every country.
We may change, add or remove features, limits and design for valid reasons: to improve Chit; to fix bugs or security issues; to respond to changes in the law, app store rules, our providers or our costs; to prevent misuse; or because a feature is little used or no longer viable. Section 15 covers changes that affect Chit Pro.
We may stop offering Chit or any online part of it. Where reasonably possible, we will give at least 30 days’ notice in the app or by email before switching off accounts, sync or sharing, unless legal or security reasons require us to act sooner, so you can keep what you need. Data on our servers will then be deleted as the Privacy Policy describes. The app may keep working on your phone for a time, but we do not promise it will.
22. Closing or suspending accounts
If you want to leave
You can stop using Chit at any time, and delete your account in the app (Me → Chit account → Delete account) or by emailing privacy@chitsplit.app. The Delete account page has the details. Deletion is permanent. It removes your account and everything it owns on our servers, including receipts you own that you have sent to others, so participants lose access to them, and revokes Sign in with Apple. Data on your phone stays until you delete it. Other people’s receipts and contacts, including ones that show you, remain theirs. Deleting your account does not cancel Chit Pro.
If we need to act
We may suspend, restrict or close your account if you seriously or repeatedly break these Terms; if we reasonably believe your use is unlawful, fraudulent or puts others, us or Chit at risk; if the law, a court, an authority or a provider we depend on requires it; or if we stop offering Chit under section 21. Where reasonable and lawful, we will tell you first, explain why and let you respond; in serious cases we may act immediately.
When your account is closed, your licence to use Chit’s online features ends and your data on our servers is deleted as described on the Delete account page. Sections 9, 10, 16, 23 to 25, 27 and 29, and any other parts that by their nature should continue, still apply.
23. No guarantees
Chit is provided “as is” and “as available”. To the maximum extent permitted by law, we make no promises, warranties, conditions or representations about Chit, express or implied, including about its quality, fitness for a particular purpose, accuracy, reliability, availability, security or compatibility, or that it is free of bugs, errors or viruses, or that defects will be fixed. In particular, we do not guarantee that recognition, splits, insights or AI answers are correct; that data will be kept, synced or recoverable; or that other users are who they say they are, are honest or will pay.
If you are a consumer, you have legal rights that these Terms do not affect. For example, paid digital content and services must be as described, fit for purpose and of satisfactory quality, and services must be provided with reasonable care and skill. For free advice, contact Advice Direct Scotland or, elsewhere in the UK, Citizens Advice.
24. Our responsibility to you
What we do not exclude
Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- your rights as a consumer that the law does not allow us to exclude or limit, including your remedies under the Consumer Rights Act 2015 for faulty paid digital content or services, and for damage to your device or other digital content caused by our failure to use reasonable care and skill;
- your rights under data protection law, to the extent they cannot be limited;
- anything else the law does not allow us to exclude or limit.
Every other exclusion and limit in these Terms is subject to this list, and applies only as far as the law allows.
What we are not responsible for
To the maximum extent permitted by law, we are not responsible for any loss or damage arising from:
- money: any payment, debt, overpayment or underpayment, money lost or not recovered, payments to the wrong person or account, and any arrangement or dispute between users;
- other people: the content, acts or omissions of other users or third parties, including fraud, scams, impersonation, fake share images, harassment and misuse of what you shared with them;
- input and choices: wrong or incomplete content entered by you or other participants, recognition or splits you did not check, rules and permissions you set, and AI proposals you apply;
- sharing: receipts or share images sent to the wrong person or group, a placeholder linked to the wrong account, payment details you include, and what recipients do with copies;
- access to your account through your phone, your email, a sign-in code or your Apple or Google account, unless it results from our failure to take reasonable care;
- lost data: data never synced, a lost or replaced phone, deleting the app or your account, expiry of shared receipts, and edits lost in sync conflicts or because of connection problems;
- your phone and connection: device faults, the operating system, other apps, malware, modified devices, incompatibility and lack of connection;
- third-party services (section 20) and events outside our reasonable control (below);
- bugs, errors, interruptions, data loss or security incidents that happen despite our using reasonable care and skill;
- relying on insights, AI answers or Chit records for financial, tax, legal or business decisions, or presenting them as official records.
Foreseeable loss and the limit on amount
If we break these Terms or fail to use reasonable care and skill, we are responsible only for loss you suffer that is a foreseeable result. Loss is foreseeable if it is obvious it will happen, or if both you and we knew it might happen when you started using Chit.
To the maximum extent permitted by law, our total liability to you for all claims arising out of or in connection with Chit or these Terms, whether in contract, delict (including negligence), breach of statutory duty or otherwise, is limited to the greater of £100 and the total you paid for Chit Pro in the 12 months before the event giving rise to the claim.
Business use
If you use Chit other than as a consumer, then to the maximum extent permitted by law: all terms implied by law are excluded; we are not liable for any indirect or consequential loss, or for loss of profit, revenue, business, contracts, goodwill or data; and our total liability is limited to the total you paid for Chit Pro in the 12 months before the event giving rise to the claim.
Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, such as failures of the internet, power, hosting or app stores; changes Apple or Google make to their systems; outages at our providers; cyber attacks we could not reasonably have prevented; natural disasters, epidemics, war, strikes, government action or changes in law. We will take reasonable steps to limit the effect. If such an event lasts a long time, we may end the affected service, and section 15 covers any paid period you cannot use.
25. Your responsibility to us
You are responsible for how you use Chit and for your content. If you break these Terms or the law, or infringe someone’s rights, through Chit, and this causes us loss or leads to a claim against us by someone else (such as another user, a person whose information you entered, a rights holder or an authority), you are responsible, to the extent the law allows, for the losses, damages, fines and reasonable costs, including legal costs, that we incur as a result. If you are a consumer, this applies only to loss that is a foreseeable result of your breach. If you use Chit for business, you will compensate us for all such losses in full.
26. Changes to these terms
We may update these Terms for valid reasons, such as changes to Chit, its providers, the law or app store rules, security, preventing misuse, or making them clearer. The date on this page shows when they last changed.
Corrections and clarifications apply once published. For changes that significantly affect your rights or obligations, we will give reasonable notice in advance, normally at least 30 days, in the app, by email or on this website, unless the law, security or misuse requires a change sooner. If you have an account, we may ask you to accept the new Terms before you continue using account features. If you do not agree, stop using Chit, delete your account and cancel Chit Pro (section 15 explains when a refund may be available). If you keep using Chit after a change takes effect, you accept it as far as the law allows. Changes do not apply to disputes that arose before they took effect.
27. Law, courts and complaints
If you are unhappy with Chit, contact us first at support@chitsplit.app. We aim to reply within 14 days and will try to resolve the problem fairly.
These Terms, and any dispute or claim arising out of or in connection with them or Chit, including non-contractual disputes or claims, are governed by the law of Scotland.
The Scottish courts have jurisdiction. If you are a consumer living in England and Wales or in Northern Ireland, you may also bring proceedings in your local courts. If you are a consumer living outside the UK, you keep the protection of the mandatory consumer laws of the country where you live, including any right they give you to bring a claim in your local courts. If you use Chit for business, the Scottish courts have exclusive jurisdiction.
28. App Store and Google Play
Apple App Store
If you got Chit from Apple’s App Store, these Terms are the licence agreement for the app, and the following also apply. Where they conflict with anything else in these Terms, this part applies.
- These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for Chit and its content.
- Your licence is limited to a non-transferable licence to use Chit on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Chit may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
- We are solely responsible for any maintenance and support for Chit, as set out in these Terms or required by law. Apple has no obligation at all to provide maintenance or support for Chit.
- We are solely responsible for any product warranties, express or implied by law, to the extent they are not effectively disclaimed. If Chit fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for Chit to you. To the maximum extent permitted by law, Apple has no other warranty obligation for Chit, and as between you, us and Apple, any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to Chit or your possession or use of it, including product liability claims, claims that Chit fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that Chit, or your possession or use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, that you are not on any US Government list of prohibited or restricted parties, and that you are not subject to UK sanctions.
- Questions, complaints or claims about Chit should be sent to us using the details in section 30.
- You must comply with any applicable third-party terms when using Chit, such as your mobile network agreement.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right (and is treated as having accepted the right) to enforce them against you as a third-party beneficiary.
Google Play
If you got Chit from Google Play, these Terms are between you and us, not Google, and Google is not responsible for Chit or its support. Your use of Google Play and purchases there are also governed by the Google Play Terms of Service and Google’s refund policies, which apply where they conflict with these Terms on Google’s own services.
29. General
These Terms, the Privacy Policy, the AI terms if you accept them, and any terms shown in the app when you buy Chit Pro are the whole agreement between you and us about Chit, and replace any earlier ones. This does not limit liability for fraudulent misrepresentation.
We may transfer our rights and obligations under these Terms to another organisation, for example a company set up to run Xxxxxxx Systems’s products or a buyer of Chit. We will tell you, and your rights under these Terms will not be reduced; if you are unhappy, you can stop using Chit and delete your account. You may not transfer your rights or obligations without our written agreement.
Apart from Apple and its subsidiaries under section 28, no one else has any right to enforce these Terms, including under the Contract (Third Party Rights) (Scotland) Act 2017 or the Contracts (Rights of Third Parties) Act 1999. Other users cannot enforce these Terms against you or us.
Each part of these Terms, and each item in every list, operates separately. If a court or authority decides that any part is unlawful, unenforceable or unfair, that part applies to the greatest extent allowed, or is removed if that is not possible, and the rest stays in full force.
If we delay or do not enforce any of these Terms, we can still enforce them later. Headings and the key points summary do not affect the meaning of these Terms, and “including” and “for example” do not limit the words before them.
We may send you notices by email to the address on your account, through the app or on this website. You can send us notices at support@chitsplit.app.
